and GUIDANCE & PROTOCOLS FOR POSTING

1.0 Definitions

1.1 TheDukesofHazzard.nl is a Fan Website dedicated to American television series The Dukes of Hazzard. TheDukesofHazzard.nl is owned by Alma van Hensen , who enlists the help of volunteers to create and distribute its services to consumers.

1.2 The title "TheDukesofHazzard.nl" is used to refer to the website and forums, found at uniform resource locator http://www.thedukesofhazzard.nl. Unless otherwise specifically stated, "TheDukesofHazzard.nl" does not refer to, nor accept responsibility for, the services and/or information available via the world wide web and/or Internet (in any form or by any means) unless such services and/or information are presented in full on a web page or web service provided at (or under or as an adjunct to) the uniform resource locator http://www.thedukesofhazzard.nl.

1.3 The term "Online Services" refers to any publically accessible (where 'publically accessible' is used to refer to visitors to/consumers of TheDukesofHazzard.nl excluding TheDukesofHazzard.nl Messageboard Moderators and/or Administrators and/or TheDukesofHazzard.nl Staff) information available at TheDukesofHazzard.nl.

1.4 "TheDukesofHazzard.nl Messageboard" and "Messageboard" and "MB" refer to the Online Services available at TheDukesofHazzard.nl specifically located at, under and as an adjunct to the uniform resource locator http://forum.thedukesofhazzard.nl.

1.5 "TheDukesofHazzard.nl Messageboard Moderators and/or Administrators" (also hereafter referred to as "Staff") refers to the volunteer staff (defined in section 1.0 Definitions: 1.1) who administer the Online Services (defined in section 1.0 Definitions 1.4).

1.6 "TheDukesofHazzard.nl Staff" (also hereafter referred to as "Staff") refers to volunteer staff (defined in section 1.0 Definitions: 1.1) who are not identified as "TheDukesofHazzard.nl Messageboard Moderators and/or Administrators".

1.7 "User" and "Users" are identified as anyone other than TheDukesofHazzard.nl Messageboard Moderators and/or Administrators and/or TheDukesofHazzard.nl Staff.

1.8 "Terms & Conditions of Use" (also hereafter known as "T&C" and "T&C's") refers to this document and its contents in their entirety. Use of the Online Services of TheDukesofHazzard.nl, including the TheDukesofHazzard.nl Messageboard, indicates the express and unmitigated complete understanding of those contents, as well as the complete waive of rights of the user, specifically, that the user agrees to abide by the "Terms & Conditions of Use" as defined and expressed herein.

1.9 "Advertising" and "Unsolicited Advertising" refers to the mention of, via textual prose, hyperlink and graphology (whether image file or otherwise) any Online Services not provided by TheDukesofHazzard.nl (including the TheDukesofHazzard.nl Messageboard) unless otherwise explicitly stated by TheDukesofHazzard.nl Messageboard Moderators and/or Administrators and/or TheDukesofHazzard.nl Staff.

1.10 "Post" and "Posts" refers to the contribution/s and submission/s via the Online Services at TheDukesofHazzard.nl and the TheDukesofHazzard.nl Messageboard of information (in any form) by User/s.

1.11 "Signatures" refers to the repeated use of information in a User's Posts. (Where 'repeated' is defined as the use of information, presented in the same graphological form more than once and as an affix to a Post from a User.)

1.12 "Guidance & Protocols for Posting" refers to the guidance and protocols, defined and explained in this document, which are concerned with establishing codes of acceptable conduct in the form of, but not limited to, the contributions via Online Services at and to TheDukesofHazzard.nl and specifically, the TheDukesofHazzard.nl Messageboard in the form of, but not limited to, Posts from Users.

2.0 Staff Decisions

2.1 In all cases, the decisions of the TheDukesofHazzard.nl Messageboard Moderators and/or Administrators, including TheDukesofHazzard.nl Staff are final. These Terms & Conditions of Use are presented as a guide and as a binding agreement to the User and not as a foundation for challenging said decisions.

3.0 Moderation & Liability

3.1 The TheDukesofHazzard.nl Messageboard is Moderated (where 'Moderation' and 'Moderated' is defined as the review by Staff of contributions via User's Posts as a prelude to possible subsequent alteration and editing) to ensure said contributions meet the criteria defined in Section 4.0 Policy on Deleting & Banning.

3.2 Unless explicitly stated otherwise, Staff reserve the right to Moderate at any time.

3.3 TheDukesofHazzard.nl guarantees User contributions will be reviewed for Moderation, but accepts no responsibility for the content of User Posts either pre-moderation or post-moderation, and at no time is TheDukesofHazzard.nl and/or its Staff obliged to Moderate where contributions from Users do not contravene the points defined in Section 4.0 Policy on Deleting & Banning.

3.4 The opinions expressed by Users are not those of TheDukesofHazzard.nl and/or its Staff. TheDukesofHazzard.nl and/or its Staff cannot accept responsibility and/or liability for injury (of any kind or by any means) suffered as a result of exposure (direct or indirect, explicit or implied) to contributions from Users, available to the public via the Online Services at TheDukesofHazzard.nl, including the TheDukesofHazzard.nl Messageboard. As an extension to this;

3.5 TheDukesofHazzard.nl and/or its Staff reserve their rights, in whole, to select the degree to which contributions from Users may be Moderated, but are not obliged to Moderate where contributions from Users do not contravene the points defined in Section 4.0 Policy on Deleting & Banning.

4.0 Policy on Deleting Posts & Limiting User Access

4.1 Except for instances governed by points 4.9 and 4.10 (below), Staff do not delete Posts from Users that criticise TheDukesofHazzard.nl.

4.2 Staff do not delete Posts that contain news from other Fan Sites.

4.3 Staff do not delete Posts that contain news or speculation from Users, but reserve the right to edit such contributions.

4.4 Staff do delete and/or edit Posts that express offensive language or sentiments. The decision as to what is and what is not offensive remains at the discretion of the Staff.

4.5 Staff will always, and without fail, delete and/or edit Posts that express sexism, racism, homophobia, and/or other forms of prejudice and discrimination.

4.6 Staff delete and/or edit Posts that they consider disrespectful to other Users. The decision as to what is and what is not disrespectful remains at the discretion of the Staff.

4.7 TheDukesofHazzard.nl and its Staff reserve the right to ban any User who, after receiving an official warning from a member of Staff, continues to contribute Posts and/ Signatures that contravene any of the rules defined in these Terms & Conditions of Use.

4.8 TheDukesofHazzard.nl and its Staff reserve the right to prevent any User/s from accessing the Online Services (whether or not said User/s have paid to access them) without prior notice, but only where said User/s have directly broken the rules as defined and explained in these Terms & Conditions of Use and/or when said User/s have presented Staff with justifiable reasons to prevent their continued use of said Online Services. The definition of 'justifiable reasons' remains at the complete discretion of the Staff.

5.0 ADVERTISING

5.1 Unsolicited Advertising is, without exception, forbidden.

5.2 Users wishing to advertise on TheDukesofHazzard.nl and/or the TheDukesofHazzard.nl Messageboard must apply to TheDukesofHazzard.nl in writing for permission.

5.3 Unsolicited Advertising will be removed without exception.

5.4 TheDukesofHazzard.nl reserve the right to prevent any User/s access (whether paid or otherwise) to the Online Services if said User/s have been found responsible for Unsolicited Advertising.

5.5 Users granted permission to advertise on TheDukesofHazzard.nl and/or any of its related Online Services are bound to agree with the requirements and restrictions placed on said Advertising by TheDukesofHazzard.nl. Full details of said requirements and restrictions will be made available by Staff on request.

6.0 SIGNATURES

6.1 Users are required to ensure their Signatures are as small as possible. (Where 'small' is used interchangeably to refer to both the graphological dimensions of the Signature and/or the Signature's file-size in relation to bandwidth consuption.)

6.2 Staff reserve the right to contact any User/s at any time to request said User/s modify their Signature.
